Definitions

  1. XBSHIP as used in these terms and conditions refers to operating entities for XBShip.com, and including Global Porters LLC (2360 Corporate Circle Ste 400, Henderson, NV 89074-7722), its agents and contractors (FedEx, DHL, Yamato Transport, UPS, etc.).
  2. The CUSTOMER is consignee (the person to whom the shipment is to be delivered whether by land, sea or air). The SHIPPER and CUSTOMER are the same person (this person buys products online from US merchants, sends them to be received by XBSHIP, pays XBSHIP for transportation services, and receives the products [is both consignee and shipper]) .

Terms

  1. XBSHIP may perform shipping related services such as documentation, opening boxes received and repackaging items, paying customers duties and taxes if paid for first by CUSTOMER , act as shipperfs forwarding agent and as receiver only for customs clearance purposes, and deliver as directed by CUSTOMER . All the CUSTOMER merchandise is subject to inspection.
  2. CUSTOMER agrees to ship only items acceptable and allowed for transportation from the US to destination country. CUSTOMER agrees items are unacceptable for shipping if deemed hazardous, dangerous, legally not allowed or restricted by the US or destination country. In this case, items may be returned to retailer or disposed of and a handling fee will be quoted and charged for these services; handling fee also applies if CUSTOMER decides to have XBSHIP return merchandise to the retailer for whatever reason. Items left longer than 30 days will incur a storage fee and items left over 60 days will be assumed abandoned and be disposed of or liquidated. CUSTOMER certifies and agrees that products sent to XBSHIP were paid for with a credit card, debit card, or other payment source for which CUSTOMER is properly authorized, and that items have been rightfully purchased by the CUSTOMER. CUSTOMER agrees not to use XBSHIP for any fraudulent or illegal purposes and is responsible for any resulting claims or liability for fraud or misuse.
  3. Shipments cannot be delivered to Post Office Boxes. They must be delivered to the recipientfs physical address. CUSTOMER is responsible for paying customs duties and taxes directly to the delivery person, when package is delivered. If shipment is not able to be delivered to recipient or customs duties or tax remains unpaid, attempt will be made to return package to the XBSHIP hub or be disposed of and proceeds will be used to settle amounts owed.
  4. Shipping rate will be based on the higher of volumetric weight and actual weight as is standard practice among the large global international air courier express package shipping companies.
  5. Customer agrees to insure items shipped for the actual cash value of the items. Insurance does not cover indirect loss or damages, or loss or damages caused by delays. Customer agrees to indemnify XBSHIP against any loss and liability, including that resulting from Customer's failure to comply with any applicable laws or regulations or documentation or other errors, or the result of circumstances beyond XBSHIPfs control (flooding, earthquake, typhoon, etc.).
  6. Any dispute arising under or in any way connected with these Terms and Conditions shall be subject to the courts of and governed by the law of Nevada, USA. The liability of XB SHIP shall not exceed the amount of shipping fees of the item (s). Terms and conditions are subject to update and revision by XB SHIP without notice.
